By accessing or using Roll Call (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Roll Call is a food truck management platform that provides tools for shift management, inventory tracking, maintenance scheduling, audit compliance, and calendar integration. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

3. Account Registration

• You must be at least 18 years old to use this Service
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must provide accurate and complete registration information
• You must notify us immediately of any unauthorized access

4. Subscription and Billing

Subscription Plans

Access to Roll Call is provided on a subscription basis. Fees are based on the number of locations and features selected. All fees are non-refundable except as required by law.

Billing Cycle

Subscriptions are billed monthly or annually in advance. By subscribing, you authorize us to charge your payment method on the recurring billing date.

Price Changes

We reserve the right to modify subscription fees at any time. Price changes will take effect at the next billing cycle following notice.

Cancellation

You may cancel your subscription at any time. Your account will remain active until the end of the current billing period.

5. User Conduct

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service or servers
• Reverse engineer or attempt to extract source code
• Share your account credentials with unauthorized individuals
• Use the Service to transmit harmful or malicious code
• Impersonate any person or entity

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Malagon Systems and are protected by international copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your business operations.

7. User Data and Content

You retain all rights to the data and content you upload to the Service. By using the Service, you grant us a license to store, process, and display your data solely for the purpose of providing the Service. You are responsible for maintaining backups of your critical data.

8. Third-Party Services

The Service may integrate with third-party services (e.g., Google Calendar, Square). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third parties.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MALAGON SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR REVENUE ARISING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless Malagon Systems from any claims, liabilities, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our discretion.

13. Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes shall be resolved in the federal or state courts located in Fort Myers, Florida.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.
